I think i just got scammed by a e90post user?

Well bought a JB4 from a user which has 1 positive itrader rating and almost 900 post on this site 3 weeks ago. Bought the JB4 no email back from user or call back no tracking to prove he did send it. Then he is banned now (in a weeks time) and i cant contact the user. Emailed his paypal account nothing. Well thought i would share this information, on what action i can take to get my money back. Any help is appreciated. Thanks e90

Just file a claim and hope he didnt already withdraw the money out. Paypal can lick my balls for shit like this. If the seller decides he wants to scam you, all he has to do it transfer the money as soon as you pay him and then once you file a claim there is no money to recover.

Also if you used your CC through paypal file a claim with them too.
I know because it happened to me by another scumbag e90poster.

problem with that, most of the people here want it sent as "gift" didnt know that you cant fight a gift because is it direct payment.. like a cash advance. Already have all the information about him and about to sue if i dont get a paypal/email reply back about the refund. Bank or paypal isnt cooperating to help, but paypal did forward me his information .

If its a gift paypal will not help you.

Never use gift if you do not know who the seller is.

No offence OP but this is a reminder to everyone that reads this tread to never send money as a gift through paypal. Quit being cheap and pay the 3%. It's alot easier to dispute and recoup your money. I've bought stuff from other members on this site without a hitch, but I've never sent the money as a gift.

On a side note I'm glad that idiot Thebigragu is banned.

File a complaint with your local police department first, they won't do anything but the complaint of felony mail fraud will add weight when you file in the small claims court.

Well I think everyone can agree that Bigragu99 is a complete idiot but I wouldn't automatically discount him as a scammer. Have you had any sort of contact with him at all regarding this purchase and then he suddenly stopped talking to you? or did you just send him the money with your info? If he's been banned; then he can't be contacted and not everyone checks their paypay e-mail; maybe he doesn't even know he has the money from anyone. Either way; this is a bad situation because I don't think you have any sort of legal ground... gifting money is just that, gifting and I doubt paypal will stand by anything you claim as this is pretty much giving money away. I mean it's definitely a lesson learned but I think you're out of luck.

Well what if seller says that he never received money for that particular item but instead received some sort of gift...? Let's remember there is no mention of product being sold when gifting. I think there is a lot of tricky issues here.

Only gift if the seller is trustworthy.
1 iTrader and a couple hundred posts don't qualify.

But when I got my BBK, I paid a member on here half using my CC as a goods payment, and the other half as a gift (about $2000).
But he was a known member with enough iTrader and post counts.

Don't send a gift unless you trust the seller

Small claims will be hard, but it's worth doing.
