Issue with Shop..please help

I went to a muffler shop down in Tampa and they took off my muffler and put in new piping and some tips.. Basically the muffler delete. Paid him with Credit Card Luckily.
It sounded good and I drove off and went to work. Next day I told my buddy about what I did and he asked me" Did you cut your bumper for the exhaust?" Confused, I told him um no that cut out is from the factory. (330i single sided exhaust)... I went and looked to find out that the tips had touched the actual bumper. I was mad and called him. He said to come in and we will adjust it. Went in the next day or so and he adjusted and then gave me a "office" number to call to see what they would do about my bumper...

Called office, nothing, so i left message. Next day guy calls me and i tell him what happened. He ask me: 1.what car I had, 2. What happened, 3. If i had any other mods on the car? then he said he would call me in 5 mins... Never called back. a week later i called him and he basically said ... Shit happens... He said that my guys are pros and they didnt lean it up against the bumper.. He said that he wont do anyhting for me. I also told him that Im in college and ive worked hard to get this car as ive fully paid in cash for it that ive saved up for a long time..

He says " I was young too once and I cared about little things, But once you grow up you'll get over the little scrathches and dents" That set me off He kept feeding me bs lines, i finally asked are you going to fix my bumper? he said no... are you going to send my bumper to get fixed? he says no... I said fine ill hand this over to my lawyer and he said thats fine...

Pretty mad, more upset right now as to how they can do this..

Any suggestions???

I would stop payment then contact your insurance company for advice. If your insurance company helps you out and gives some good advice and is able to get this cleared up, then I would file a complaint with the BBB and take your car to a BMW shop(assuming insurance is able to get this as the shop's fault) and have BMW send the shop the bill.

Not to be mean but never get custom work like this done unless you know the shop personally and have seen a couple sample of work from that shop under the same tech.

Insurance? They cover these? Send the bill to the shop? So you want to ask the BMW shop to collect the payment from a shop that denied to pay up? Good luck with that. Get the credit card company involved. Go to small claim court if that is not enough.

ya i plan on disputing it thru the credit card. I didnt think about insurance. but i know i can not go get it fixed then expect bmw or someone to try and collect funds. I need to think of something though.

If you have any email/written documentation of the entire process, make sure to have it on hand. Evidence will be your most helpful tool through the process. If you can provide written correspondence of events to credit card/BBB, they'll def make sure you get a refund.

I don't see why insurance wouldn't there are some interesting situations that can be covered if you picked the right insurance company, either the shop's insurance for repairs or your own for automobile.
Disputing the CC transaction is definitely the first thing, keep receipts. Small claims court as a last resort.

I don't think it's the refund that I'm worried about. I'm now worried about them fixing my bumper.
I mean there's nothing written. maybe a receipt but that's it. I've already contacted my bank Last night... They want me to send them paperwork in which I plan on doing today

In addition, OP, if you dont want the headache of dealing with all of that because it will take it months to process and clear, you could just buy a bumper which I doubt will cost you more than $500 for a painted new one if you shop around. My real worry is why the exhaust was sitting so high in the first place. It is held on by a hangar that is in a fixed position, I would check the underside of your vehicle for more damage than just the hangar. (I wouldn't be too surprised if they welded something to hold it in place which could actually make your total repair tricky which is why I suggested going to an OEM shop for a simple quote to fix this whole thing.)

I'm going to do that. as bad as it sounds I have Florida minimum insurance. I don't have full coverage. I don't know if that will matter.

Oh and bank of America told me that I need a second opinion on the damage. so I guess I'm going to take it to BMW for that?

Ask BofA what they accept as proof, never assume.

sorry..thats actually what they requested for proof. I was just picking bmw as the 2nd opinion instead of just a shop

fuck that shop sounds like a bunch of retards.
Do a credit card chargeback. All work done at a shop should have some type of a guarantee or warranty and they are not honoring that so fuck them and let them try to get their money back from you.

Was the damage there before the shop did the work?

Dispute the charge, and demand the shop pay for the repair or replacement of the bumper.

Get an estimate from a reputable body shop and provide it to the owner of the muffler shop.

BBB hasn't been very helpful from my experience.

Dude, I know the guys at the shop were dumbasses and messed up your car. But honestly how much do you think a lawyer and all this will cost you. Is it worth it in the end? Just get it checked up from a reputable shop and see if there is any other serious damage. But the bumper is barely noticeable.
