walmart screwed me... any professional help would be appreciated...

ok... i know this has nothing to do with bmw but i just had bad day and had to vent out...

here's the situation. i bought this hp laptop from walmart down renton store (store #2516) back in 28th of january, 2009. i went into the store and asked for hp laptop on the shelf. sales rep was telling me they don't keep anything on the shelves and she has to pick it up from the back. i was like, ok lets go do that. she asked me to wait outside of storage room and 20 minutes later i picked up the laptop. come to think of it now, i must have to say it was bit weird that i had to wait right in front of storage room for nearly 20+ minutes to just get the laptop...

took it home, opened up the pkg, found out that it's not brand new computer. i mean, there's scratch on top, fan on the bottom cleary shows wear on it and serial numbers not matching up with the box. i was like wth... and took it to the walmart nearby. they told me that since serial numbers not matching up, i'd have to take it to where i bought it from. so i drove all the way down to renton store again and explained it couple more times to reps and managers there. one of the assistant manager there, wii (yes that was his name), told me that the computer was purchased back in 2007 or something and hasn't been returned since so there's nothing he can do now, it'll require more investigation or what not and will contact me regarding this matter as they find something out with this case...

a week went by, nothing happened. so i called this wii guy back and told him what's going on. he said he'll check back with his boss, name frank snowman, and be back. no answer on that day. last friday, i got called from another manager, i think his name was drew i believe, basically stating that after the investigation, they can't return this product because of serial numbers are not matching up and if i still concern about this matter, contact this frank guy from asset protection.

so today, i went ahead and called this frank guy and he's basically repeating a same thing and say we never sell used product and this never happened. so i said it just did happened and i would like to see cctv or any other "investigation" of his... he said bring the laptop with receipt and he will take a look. so i drove down there again through 5 o'clock traffic, hoping he got something on it...

went there, store was really busy, waited 5~10 minutes or so and this frank guy showed up. shook hand and was going to tell him what's going on. yes i said i was going to. he cut me off and look me under and said he'll take a look. he called up another rep to take a look at transaction numbers and nothing showed up. asked same guy to check back on cctv record. apparantly that's not available. he got frustrated and looked at the laptop for like 10 second and took another quick glence at me and sales receipt. next thing i know he's asking me to leave because he "think" that i bought the computer and switch up and trying to return. so i got extremely pissed at that point and asked him "are you accusing me now, you'll be facing lawsuit on yourass for that..." and he said there's nothing going to be done today and he'll call police if i don't leave and kept threatening him.

i asked him his full name and contact info, no answers from him and he just went straight to the back, irnoring me whole time... got some info from some other customer service rep and went out because there's no point stood there by myself...

what i can't stand with it is not only i'm $650 out, but also the way this frank guy treated me. i felt like he's treating me like a teenage-punk trying to make quick bucks by switching the product and return... i never really expected anything like this would ever happen to me, especially from big company like walmart... i'm seriously considering lawsuit against them or something... for now i just needed to vent out and share some moments of my bad-day...

any thought would be appreciated... any lawyer out there???

if you are a kid...do you have parents...if paid with CC need to dispute the charges...but you really need to have a meeting with the store manager and your parents...

Sorry to hear about your experience there David. I'm not much help though, other than to say "Don't shop at Wal*Mart!" Especially that hell-hole they have in Downtown Renton.

Try calling their head office in Bentonville and explaining the situation to them. Be very nice and courteous on the phone, but firm and insistent.

Is there anything on the harddrive that will indicate who's computer it is? Was the box completely sealed when you purchased it? Maybe you can take your parents with you so you will have more credibility with them. I wouldn't believe you if i were them either to be honest.

i'm 30 year old and by no way i should be treated like this regardless of age. that's even more messed up...

It has nothing to do with your age. You should be able to identify the employee who handed you the laptop, correct? Ask to see the video since you bought it and all. Don't you have a receipt etc??

i did have receipt and they were able to locate the sale rep but that was about it. no action was taken and they even told me straight up saying they won't show me cctv record... wtf...

So you bought a brand new computer with out checking if the box was sealed? There should have been a seal on the box. Just be more careful next time, sounds like your to blame partially for being careless. But yeah, you did get screwed.

i checked the seal up top and it did look like brand new one until i took it home and looked more carefully. when it's right out of the shelve or went to best buy or big box store like this, do you really expect them to sell re-furbished stuff or banged up POS like this? i guess i was kinda naive about that part then...

My dad ran the second largest payphone company in the country before he retired. He had clients like 7-11, Best Buy, Publix, The Federal Prison System, Target, CVS, and etc.

Well one day he got a call from Wal-Mart. They fired their payphone partner and wanted him to come give a proposal. So he goes ahead and gives his presentation to the VP of Wal-Mart and some other suits. He finishes his presentation and they say they would like to have him be their supplier, but with one condition, it is on their terms. He said "Excuse me?". The VP handed him a contract with Wal-Mart's terms, which suffice it to say were extremely unrealistic and would basically make no money for my dad's company. He was a little stunned at this point. They said to him, "These are our terms, take them or leave them." Now my dad has a very short temper, so that didn't make him very happy. He got up, put his stuff in his briefcase, looked at the VP, and said, "I am firing you as a client."

The VP looked back and said, "What?"

My dad looks back at her and says, "I don't want you as a client, you are fired. What is so difficult to understand?"

The VP says, "Excuse me Mr. ____, but don't you realize who we are? We are Wal-Mart, you can't fire us."

My dad laughs at her and says, "Listen, I don't care if you are the damn Pope, I don't want you as a client. Have a nice day." And he walked out.

The bad part of the story is since the meeting was delayed he missed his flight and had to spend the night there with no clean clothes. Guess where the one place was to buy something. Yup, Wal-Mart.

One of my sisters friend's dad works for a diamond wholesaler who supplies Wal-Mart and he said the same thing about them. That they are assholes that screw the vendor and don't give a damn about anyone but themselves.

So to my point, the OP won't get anywhere by calling headquarters. The best bet for him to do is contact local media and tell them his story, I'm sure someone will want to hear it. Find out the name of the clerk who sold you the laptop. And then either find a friend who is a lawyer to help you out or file a claim in small claims court against them and subpoena the video tapes if they still exist.

Take it back to Walmart and tell them you are disputing the charges with the credit card company since they will not rightfully refund your credit card. Offer them to take the computer back.

I've now how 2 run-ins where i needed to dispute a charge and the banks were MORE than accommodating. If Walmart refuses to refund your money, the bank is the next step. In any case, if the money is refunded then the ball is in Walmart's court and they have to do something about it. Just make sure Walmart knows what you are doing.

time to go legal my friend, this here is a legal scam. Since the employee acknowledges that they sold you this piece of shit but refuse to show the video, you can go legal and sue them for false advertising, as in selling you POS when it says it is New
