Not much choice - only black one left haha
That been said I'm not a fan of a murdered cars. Imho silver one looked much better and had a greater potential given better silver color

Update!

Hey guys! Little update. Just picked up a 2009 e92 335i with 86k miles on it. It's in great condition, got it inspect by my local performance/ race shop. It already had the m3 rep bumper (which I love), ZHP shit knob, m-sport steering wheel, some aftermarket rims (not sure what brand but the guy that inspect my car loved them and said a lot of people run thoes on the track), and it's fully loaded. The two options I posted both had their cons to them and I said it's not worth buying something for so much money that I'm not full heartedly into; so I waited it out and it did me good! He listed it for 13,000, negotiated him down to 10,700. Turbos, HPFP, water pump, o2 sensors have all already been replaced. The car had a very large stack of service records directly from a BMW dealer in California all the way from 0 to about 72,000 miles.

i was going to vote low mileage, but neither are exactly "low mileage.."

go for the one that has more replaced stuff or is in better condition (drivetrain wise)

I'm with this guy. Technically 1 has less miles. But that's not a low miles example.

With that being said, if the car truly is low miles vs high mile I would always go with a low miles vs modded car. Can always add mods, can't reduce miles and wear.

I am in love with this car. So far I've done a muffler delete, VRSF catless downpipes, MHD flash, the charepipe mod where you unplug the diverter valves (planning on doing chargepipe and intercooler together sometime in the future), have a beautiful set of AC Schnitzer wheels that I blacked out, came with an m3 front bumper, and I recently got a duke dynamics rear diffuser from LTMW and am planing to do quad tips asap. Learned how to do some coding myself which is great. As far as maintaince all I have had to do so far is new rotors and breaks which I ordered from ECS Tuning for a steal! The one downside so far has been due to all my mods I dont think my clutch liked the new power/ I've been learning how to heel-toe downshift. So I ended up burning out my clutch, I now have a upgraded ACT Clutch and flywheel setup (which I believe is a single mass flywheel instead of the standard two). Hopefully this will keep me from burning out another one, this is my fourth manual car so I should be safe

I would not do a DCI. I would install a better cold air filter box like an AFE.

Why spend $450.00 on an FMIC so you can get cool air going to the turbos, but the air your putting into the FMIC is HOT air.

I'd rather put cold air into the FMIC and then put in even cooler air into the turbos.... cool air into the turbos = more HP and more pulls with less down time.

I was thinking about doing the BMS DCI, dual cone setup, cost effective, and seems to be extremely popular amongst the community.

The silver stock one. Notice, it doesnt even have window tint. Some call me strange for thinking this way, but I look at it as a non abusive owner. Sure you cant judge that by tint alone- but it falls together, completely stock, no tint, 95K miles on a 2007.

Get the 2007, it looks much cleaner too/ sharper.

How much are they asking? Honestly if I was 18 i wouldnt want the headache and go with something more reliable.. but I remember when I was 18 I wanted V8 Transams and mustangs and had em. lol But they were more reliable!
