Got a Speeding Ticket!!! Wrong car Laser'd?

Not in my E90... in my daily driver last night through GA. Has anyone had experience with getting a speeding ticket when they were not speeding?? I had the cruise on 80 and my car reads 2mph fast, so I was going 78. Every "your speed is" sign read the same, 2 under my speedo. 70mph hwy... so I thought I got busted for 8-10 over. Cop said he lasered me at 88!!! My Valentine one didn't even go off!!! I know for a fact if I was hit with laser it would of light up. I'm getting screwed big time on this deal. Cop swore up and down he knew he hit my car. In GA, they laser you from the rear when you go under an overpass. I've been working in GA 3yrs and know this very well... so if I went 88 under an overpass it would suicide.

That is some BS. I would fight it def. Do you remember if any other cars next to you were speeding? I wonder what would happen in your case. Is it your word against the police? How can they prove they def caught your car?

He told me my tail lights were distintive, led etc.... it's a '08 Lincoln MKZ. He pulled me over about 7 miles from the point of laser. There were some cars that passed me, I pull over then back to the left lane to let them through. I can't remember the kinds of cars though. IIRC one was a newer Acura Sedan... so I probably got his ticket. Cop never showed me the laser gun, nor did I ask for it. Like I said.. shocked was the name of the game at that point. Figures it's a town of like 5,000 people in south GA. I think they pull out of state people over, figuring they won't fight it b/c we're hours or days away and it's easy money.

At the moment when they have already written you the ticket, you can be an ass and ask to see the Gun and all that.

Before that try to be nice.

First do you really know how he got you, was he on an overpass, and if he got you from behind from high above the V1 may not have gone off. If not, this could be a case you were the lucky random guy he picked on and make it all up. Face it, it does happen and anyone who think the police only pull someone over they know for a fact was speed, is mistaken.

Anyway, in GA they have a law on the books that say they can not ticket someone on grade which is more than 7%. Shooting laser from and overpass down onto traffic is most likely more than 7% especially if your V1 never went off.

this guy is great if you want to fight it yourself, he has the information about the 7% grade law.

http://thegeorgiaspeedingticketkille...f_contents.php

All GA has law that states the officer must be visible 500 ft away so they can not do the old time sit behind a road sigh trick.

http://www.pacga.org/site/protected_...me5_issue3.pdf

That comes from the GA state Attorney General office

Go to court.

There isn't much you could do if the cop shows up. It is basically his word against yours.

I have a squeaky clean record. He wrote down 84mph on the actual ticket (you can see 88 in the notes box). So I don't get points, but I'm out about $100. Not sure if it's worth fighting and driving 16hrs over $100. Big crock of shiz.

It was at night, and no way did I see him 500' away. he was on the backside of overpass shoulder. Only way to see him is if you stare out your rear view mirror.

probably not worth worrying about then, shitty situation, but sometimes it's just worth coughing up just to put it behind you. 16 hours of travel would cost more in food and fuel and a potential second ticket.

I know GA has a super speeder law so you might want to check if you are over that limit, I do not think you are, since I think it 30 over but you might want to check what the threshold is. You might not need to go there, you can always hire a local attorney.

14 over is no points, $100. From there it gets very expensive quickly with points.

This.

16 hour drive = more money spent.
Lawyer = more money spent.

$100 is your cheapest way out of it. Sucks, but that's the facts. If you want to fight it on principle, that's different.

Should have told him that it was impossible to be going 88, for you would have time travelled. Open and shut case.
