BMW driver flipped on rear fog when I passed

So I was passing an older BMW and the driver flipped on his rear fog (left which was the same side I was passing on) just as I was overtaking him. Who does this? What does it
Mean?

First time I have seen this in California. Scared me at first because I thought he was signaling to move into my lane.

Volvo S60's are pretty bad too. A friend of mine would drive around with it on because he thought it was cool, until I was driving behind him and bitched him out for it, lol.

some possibilities:
1. old car hatin' on new car
2. old guy hatin' on young guy
3. he deliberately timed the fog activation to frustrate your overtaking move
4. he wants to show his latest 'mod'

Maybe he was just saying HI and paying hommage to another person in his make of car?

Or.. maybe he is just a douchebag BMW owner that was given the car and hates every minute of ownership and wants to make others just as miseable as he is...

Number 2 is out because it was dark and he couldn't see me. Number 1 is possible, but maybe "jealous" or "envious" would be more appropriate. 3 and 4 are quite possible, I am not an expert on older BMWs but I would guess his car (small, probably a 3 series) was over ten years old, so I doubt people spend much time making little mods like that to a beater. Does anybody know if the older BMWs came with rear fogs enabled?

On the other hand, maybe his right brake light was out and he was braking. I guess that is the most likely situation. I didn't hang around to check it out. I doubt he was being malevolant, the bad thing to do would have been to put on the left signal just as I was making my approach.
