I know this is kinda a random topic but all u guys have been helpfull in the past. Driving home yeterday i take a right turn and accelerate off- apparently there was a cop behind me on the light and saw me do so and i think "heard my exsaust", So he chases me down and pulls me over. He claims i was going above the speed limit "45" saying i was going at least over 65. I asked him how he knew i was speeding and wether he had me on radar and he said "no i saw u pull by me and u were going faster" than 45. So i told him i dont remember passing you and he says hats because i did not, he was behind me the whole time. So i guess my real question is does he have any real evidence that i was speeding and can i win this case. This would be my second speeding ticket- how much do you need to get your liscence suspended.

Just do a trial by declaration. Usually you'll win that. I don't remember the link to the site about it, it's burried somewhere on the cali forums on my post about the HOV lane ticket.

You have no case.

A cop is allowed to estimate your speed by following behind. If the cop goes 45, and you're moving ahead, you're clearly going faster.

He probably said "65" so that you would incriminate yourself by saying, NO WAY I wasn't doing over 60!

Then the cop would give you a ticket for 59/60mph

How is saying "I wasn't doing over 60!" admitting to doing close to 60?

To a cop it is like saying "I was speeding, but not that fast."

Because you have no reason to bring up a specific number unless you know you were driving about that fast. If you were doing 50, and a cop says you were doing 65, you wouldn't say "I didn't go over 60." If you do say anything in your defense at all, you will probably mention 50 (or little lower number), since you know that's how fast you were going.

yesterday I went to court with my boyfriend about one of his tickets. Another guy was on trial for speeding and his lawer actually said, "he was speeding to avoid a WILD animal."

HAHAHAHAHAHAHAAHAHAHAHA!
