I suggest you examine the policy very, very closely. If you aren't named as a driver on your mom's insurance policy and you don't have a policy of your own, then you are likely driving without insurance.

as stated in the first post i got a ticket last april of 07. i paid the bail and the court lady said i will recieve a court date in 2-3 months. it is now feb 08 and i never got anything nor have i got another ticket or violation of any sort.

maybe the court is waiting for me to f up again so they can bash me harder or maybe (and im seriously hoping this is true ) they will just forget about it after a duration of time passes without me having another ticket or violation?

No they are not waiting for you to f up again...the only way the courts can do that is put you on probation if agree not to f up again within a year (in front of the judge that is).
F up within a year and you will get the book thrown at...ie the first ticket will be charged and the second ticket at the same time.

In your case, the courts are backed up over a year in cases so it will be anywhere from a year to three.

There are 2 ways to un-suspend your license in NYS.

1. Post bail and plead not guilty, wait for the trail day.

2. plead guilty and pay the fine in full + surchages

Option 1 seems like the best option since the driving course does cost money and time. And the difference of a point in your record is crucial for insurance & future tickets/etc.

Not only that, there is a major increase of traffic ticket cases being challenged due to this:
http://www.nydmv.state.ny.us/drp.htm

and if you fall under that, ie getting more than 6 points on your license under 18 months, you will have to pay a fine of $300 total over three years, ie $100 for every year for 3 years. Or you can pay all at once.

My friend is a traffic lawyer for NYS and he sees alot of new clients calling his office to fight traffic tickets more than before. Some of them even are crazy when they call like they want to declare war on the NYS DMV.

I'd go with a lawyer. The last time I got a ticket for "racing" )which was BS I was following my buddy and the cop said we were racing) I got a lawyer and by time everything was over there had been an internal affairs investigation, the ticket was droped, I recieved an official apology from the Yuma Police Department, and from then on as long as I was driving that mustang, no matter how stupid I was being, cops left me alone. You just have to find a good lawyer and it'll all work out

when i get the letter in the mail one day i plan on going w/o a lawyer. so much time will have passed by and what i will say is that i was following a friend home and it got reported as "racing". my friend was speeding, reason for him being ahead in his jeep, the cop originally pulled him over but saw me right behind and decided to give me a speeding ticket too.

will that pass by? it is basically true.

^ have you used their services before? they are located in spring valley which is pretty close to me. anyone got recommendations for lawyer, ticket serive, etc? i also im thinking about ticketclinic.com.

i got the letter in the mail saying court date is on 5/13/08 9.30 am

4/23/07:
me and my friend ate mcdonalds and decided to crash at his place. so it's 1.30am and im following him to his house (jeep wrangler). while driving to his house, a cop came out of the night and pulled my friend over and i tried to continue (make a turn or something), but the officer quickly got out of his car and pointed me to pull over as well.

so when asked what we did wrong he replied speeding, going 65 in a 35mph. so me and my friend both got the same ticket and at the bottom it also noted that we were "racing" which is nonsense as i was following my friend to his house and he had a jeep and me a bmw (doesn't really matter but just saying).

were me and my friend really going that fast? no way. i had my valentine one and no signal went off and yet the ticket says the speed was measured by PACE (which i believe is the radar they use). my friend had a cobra radar and his didn't go off either. now i was not racing first off and was no way going 65. at the highest me and friend are going 45-50 but 65 is no way. i pleaded not guilty.

my friend (best friend from elementary school) is now living in thailand so he just paid off the ticket and went away as he didn't have to care anymore. me on the other hand is a different story.

??/??/07:
after pleading not guilty i got my 1st court date on ??/??/07 (don't have exact date with me). i missed the court date and 3 days later i got a letter in the mail saying my license will be temporarly suspended until the problem is resolved. so i drive to the court house and i paid a $200 bail to keep my license valid and for another court date.

4/12/08:
today i got a letter from court saying i have court date on 5/13/08 9.30am. so im wondering if anyone here has experience, connection, etc to a speeding ticket guy that can help at good price. im not looking for the best just someone that knows what he's doing. thanks guys.

Remember that when the lawyer says "pay me $750 and I'll get your ticket reduced," he is really saying "pay me $750 and I'll *try* to get your ticket reduced. It's up to the judge that day what actually happens, and lawyers cannot guarantee anything. (Except that they'll cash your check in a timely fashion.)

PS: Don't miss court dates, that is really a serious screw-up... more serious than the speeding itself.

Oh, and PPS: Judges have heard every single lie ever told, 10,000 times, by better liars than you or me. They will sniff out in about 0.0004 seconds if you are "crafting" your testimony in any way.

FWIW I think PACE means that the cop was pacing you, therefore the radar detectors wouldn't have gone off. Pacing is when the cop follows behind you to gauge your speed based on what it says on his speedometer.

HOLY SHIT GUYS!!!! i just got the ticket and at the back it reads:

6. Defendant's Speed: 65 MPH in a 35 MPH Zone
7. Charge based on Officer's Direct Observation
8. SPeed Verified By PACE

now when me and friend passed the officer he pulled out of a parking lot didn't even pace us but just put on his sirens and pulled over my friend. that means he couldn't have paced us at all he just came out and put on sirens.

so in this case i have advantage here right?

Lol that is not how it works son, trial doesnt work like that you dont have evidence, get a lawyer and he may get it differed and DD, suck up your pride its worthless protection for getting nailed by the long dick of the law.

Don't know if this will help you –

To pace a car,,,, the speed is matched,,, being careful not to gain on the target vehicle. He'll probably say he placed his patrol unit at X speed and you were pulling away slightly,,,, so you were doing AT LEAST the charged speed. Are you sure he didn't use radar from the rear antenna to show his speed on the road. Even if he didn't have radar, how hard is it to follow someone, match their speed and look at your own speedometer? You do it daily to determine the speed of vehicles around you and whether you need to watch for cops or not.
Pace does not require a set distance marked off. His possible misjudgment in court of a distance means doodle to what he did to catch you. He is required to follow you only long enough to establish your speed. Some agencies say one block or so.
It doesn't take long for him to pace you, so it depends on when he turned his sirens on, but the onus is on you to show that he turned his lights on before he could get a read of your speed. It's hard to win, to be honest, if it's his word against yours.

Its a pretty established system, if you try to fight it you will mess up in court, every non lawyer does, if you get a lawyer they will bargin with the prosecutor (Good lawyers have them on payroll). Get a lawyer and take what they offer you.
