I don't really understand why you're upset. Tires are a wear item with tread life that varies depending on how the car is driven and the minimum tread depths at turn-in are spelled out in your lease contract. My 135i needed a new set toward the end of the lease as well and I changed over to snow tires each winter, which meant I probably had 15k on the stockers at most. That aside, I agree with others about buying a used set off a forum member (that's what I did).
The only warranty I see is 2/32" for the first year. You're well outside of that.
